In New Jersey, state law says that you give your consent to allow officers to give you a BAC test in exchange for the privilege of driving on the roads owned by the state. This is called "implied consent." The penalty for the refusal of the BAC test is serious, including the possibilities of:

  • Driver's license suspension of seven months to one year for a first offense
  • Driver's license suspension of up to two years for a second offense
  • Driver's license suspension of ten years for a third offense
