What Crimes Can Be Expunged
New Jersey criminal law specifically outlines which crimes can be expunged from criminal records and what requirements must be met to have your record cleared. If you were arrested in connection with a crime or charged without being convicted, that record can be expunged immediately.
If you were convicted or pleaded guilty to a nonindictable or disorderly person offense, you must wait five years before the record can be expunged. If you were convicted of or pleaded guilty to an indictable offense, there is a 10-year waiting period before the record can be expunged. Under certain circumstances, however, it is possible to have the record of the arrest and conviction expunged after only five years, provided certain conditions are met. Some indictable offenses cannot be expunged. The list of excluded criminal convictions is long, but includes:
- Homicide, except vehicular homicide
- Kidnapping
- Robbery
- Aggravated sexual assault or criminal sexual contact
- Arson
- Perjury and false swearing
- Terrorism
- Human trafficking
There is also a limit on the number of records that can be expunged. While you can only expunge one indictable offense, you can clear your record of three disorderly or petty disorderly offense convictions.
How Expungement Works
